1. Introduction & Acceptance of Terms
Welcome to mymyduo.com (the "Application" or "Platform"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Maimaiduo Private Limited, a company incorporated under the laws of Nepal, with its registered address at Lalitpur 4, Bagmati Province of Nepal ("Company", "we", "us", or "our").
By downloading, installing, registering, accessing, or using the Application on either Apple iOS or Google Android operating systems, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Return & Refund Policy. If you do not agree to these Terms, you must immediately cease using the Application and uninstall it from your device.
2. Scope of Services & Cross-Border Framework
The Application serves as a cross-border e-commerce platform that facilitates the display, procurement, sourcing, and international shipping of commercial goods, garments, lifestyle products, and consumer wares directly from manufacturing and wholesale markets in China (including but not limited to Guangzhou) to users located in Nepal and designated South East Asian countries.
You acknowledge that the Company acts as the platform provider and, depending on the fulfilment model selected, may act as either the direct merchant of record or a cross-border logistical facilitator matching users with third-party suppliers and shipping handlers.
3. User Eligibility & Account Registration
3.1 Eligibility
You must be at least 18 years of age (or the legal age of majority in your place of residence, such as 18 under the National Civil Code of Nepal) to create an account and execute financial transactions through this Platform. By registering, you warrant that you possess the legal capacity to enter into binding contracts.
3.2 Account Security
To access purchasing functionalities, you must create a secure account. You are solely responsible for maintaining the confidentiality of your login credentials (username, password, or OTP tokens). Any activity occurring under your account will be deemed your legal action. You must notify us immediately at contact@mymyduo.com of any unauthorized account access.
3.3 Account Deletion (Mandatory App Store Compliance)
In accordance with Apple App Store Review Guideline 5.1.1 and Google Play Policy, you have the right to delete your account at any time. This option is available directly within the App Settings under "Account > Delete Account". Upon deletion, all personal data, purchase histories, and virtual assets will be permanently removed or anonymized, subject to mandatory statutory financial/tax retention regulations under applicable Chinese and local cross-border laws.
4. Pricing, Currency, and Payment Mechanisms
4.1 Currency Conversion & Display
Prices displayed on the Platform may show in Chinese Yuan (RMB), United States Dollars (USD), Nepalese Rupees (NPR), or other local South East Asian currencies. Unless explicitly stated otherwise, the base clearing currency is RMB. Conversions to local currency are provided for convenience only and are computed based on prevailing commercial foreign exchange rates plus a standard processing margin. The mathematical relationship governing the final converted settlement price (Pₛ) is expressed as:
Pₛ = Pᵦ × FX_rate × (1 + μ)
Where Pᵦ represents the base product price, FX_rate represents our reference interbank conversion rate on the date of transaction, and μ represents the cross-border platform conversion margin e.g., 0.025 for 2.5%.
4.2 Payment Gateways
- Physical Goods: Payment for physical goods and associated freight charges will be processed through traditional international credit/debit cards, cross-border digital wallets, or certified local digital payment ecosystems authorized in the destination country (e.g., eSewa, Khalti, or bank transfers in Nepal).
- In-App Digital Features: If the Application introduces premium digital access, virtual badges, or subscription tiers, such payments will be routed strictly through the Apple In-App Purchase (IAP) system for iOS or Google Play Billing for Android, in compliance with Apple Guideline 3.1.1 and Google's monetization policies.
5. Cross-Border Shipping, Customs, and Importation
As the goods originate from China and are delivered internationally to Nepal or South East Asian nations, specific customs structures apply:

The explicit shipping framework chosen by the user at checkout dictates liability. The Company shall not be liable for delivery blockages, confiscations, or delays resulting from a user's failure to provide valid identification or tax registrations required by local customs authorities (such as the Department of Customs, Nepal).
6. Prohibited Items and Acceptable Use
Users are strictly prohibited from utilizing the Platform to purchase, import, or distribute items that violate either the laws of the People's Republic of China, international transit regulations, or the domestic laws of the importing country (e.g., items banned under Nepal's prevailing import restriction notices). Prohibited categories include, but are not limited to: counterfeit goods violating intellectual property rights, hazardous materials, narcotics, unapproved medical devices, and items inciting political or religious instability.
7. Intellectual Property Rights
All contents of the Application, including but not limited to text, software, code, graphics, user interface designs, brand logos, product photography, and metadata layout, are the exclusive property of the Company or its licensing partners in China. No user gains any ownership or intellectual property rights by downloading or interacting with the app. You are granted a limited, non-transferable, revocable license to use the app for personal or structured commercial sourcing purposes strictly in compliance with these Terms.
8. Limitation of Liability and Warranties
The Application and its services are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. To the maximum extent permitted under applicable law, the Company disclaims all liability for indirect, incidental, special, or consequential damages arising out of cross-border shipping delays, manufacturing variations, exchange rate shifts, or temporary server outages affecting the Android or iOS platforms.
9. Termination of Service
We reserve the operational right, without prior liability, to suspend, restrict, or terminate your account and app access if we detect a breach of these Terms, fraudulent payment practices, manipulative scraping of product data, or behavior that threatens the security of our cross-border supply chain.
10. Governing Law and Dispute Resolution
10.1 Governing Law
These Terms shall be governed by, interpreted, and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law principles.
10.2 Arbitration & Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to the use of this Application, product procurement, or these Terms shall be submitted to the Guangzhou Arbitration Commission (GZAC) for arbitration, which shall be conducted in accordance with its arbitration rules in force at the time of application. The language of arbitration shall be English or Chinese as determined by the tribunal. The arbitral award shall be final and binding upon both parties.
Notwithstanding the foregoing, for localized logistics and terminal delivery disputes occurring inside Nepal or future South East Asian jurisdictions, the Company reserves the option to seek equitable relief or address specific enforcement actions through competent local tribunals.
